Call your bank\u2019s 24-hour fraud line for help <u>immediately<\/u><\/strong> (google for the number if you are unsure)<strong>. <\/strong>In most cases, the operator will cancel\/freeze your card to prevent anyone from using the card for transactions.<br \/>\n<span style=\"color: #ffffff;\">p<\/span><br \/>\n<strong>If no money is lost from this, then make a bank appointment for a new card. You may be charged a small fee for the new card.<\/strong> If money is lost in this incident, proceed with the next steps.<br \/>\n<span style=\"color: #ffffff;\">p<\/span><\/span><\/li>\n<li><span class=\"font-500830\"><strong>If money is lost: File a police report on this matter. <\/strong>Your bank will need the report for further documentation at Step 3.<br \/>\n<span style=\"color: #ffffff;\">p <\/span><\/span><\/li>\n<li><span class=\"font-500830\"><span class=\"font-500830\"><strong>Next, fill up a charge dispute form, which is usually available to be downloaded at your bank\u2019s website. Then, submit the (1) completed form, (2) your police report, and (3) other available supporting proof\/documents (eg. Receipts\/statements\/transaction slips).<\/strong><\/span><\/span><span class=\"font-500830\">Remember to make a copy of your reports and documents to support your claims.<br \/>\n<span style=\"color: #ffffff;\">p<\/span><\/span><\/li>\n<li><span class=\"font-500830\"><strong>The whole dispute investigation can take up to 90 days*. Until then, the only thing to do is to be patient and wait. <\/strong><\/span><\/li>\n<\/ol>\n<p><span class=\"font-500830\">*As per the details on <a href=\"https:\/\/cdn.hsbc.com.my\/content\/dam\/hsbc\/my\/docs\/credit-card-dispute-form.pdf\" target=\"_blank\" rel=\"noopener\">HSBC\u2019s Card Dispute Form<\/a>.<\/span><\/p>\n<p><span style=\"color: #ffffff;\">p<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Can_you_get_your_money_back\"><\/span><span class=\"font-555555\"><strong>Can you get your money back?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span class=\"font-500830\">Perhaps the next question you have is: <\/span><\/p>\n<blockquote><p><em><span class=\"font-500830\">Can I get my money back?<\/span><\/em><\/p><\/blockquote>\n<p><span class=\"font-500830\"><strong>The short answer is: It depends. Let\u2019s discuss further on this matter:<\/strong><\/span><\/p>\n<ol>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Your_card_is_a_Credit_Card\"><\/span><span class=\"font-500830\"><strong>Your card is a Credit Card <\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p><span class=\"font-500830\"><strong>If your compromised card is a credit card, chances are you\u2019ll not be liable for the loss. <\/strong>Meaning, there is a decent probability that your bank will refund you for the money lost. \u00a0\u00a0<\/span><\/p>\n<p><span class=\"font-500830\">According to Bank Negara Malaysia (BNM)\u2019s credit card guideline in 2019, credit card issuer <em>cannot<\/em> hold cardholder liable for unauthorized transactions, <em>unless<\/em> the issuer manages to prove that the cardholder has:<\/span><\/p>\n<ul>\n<li><span class=\"font-500830\">Acted fraudulently;<\/span><\/li>\n<li><span class=\"font-500830\">Delayed in notifying the issuer as soon as reasonably practicable after having discovered the loss or unauthorized use of the credit card;<\/span><\/li>\n<li><span class=\"font-500830\">Poorly management of PIN or card<\/span><\/li>\n<\/ul>\n<p><span class=\"font-500830\">Note that I tweaked the sentences shorter. Please refer to Section 15 of the <a href=\"https:\/\/www.bnm.gov.my\/documents\/20124\/938039\/PD+Credit+Card.pdf\" target=\"_blank\" rel=\"noopener\">BNM guideline<\/a> for an accurate representation. An example of HSBC\u2019s credit card\u2019s agreement below shows that credit card holders are indeed protected as per BNM\u2019s guideline:<\/span><\/p>\n<p>&nbsp;<\/p>\n<figure id=\"attachment_71224\" aria-describedby=\"caption-attachment-71224\" style=\"width: 624px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/nomoneylah.com\/wp-content\/uploads\/2021\/06\/HSBC-credit-card-contract-highlighted.jpg\"><img decoding=\"async\" class=\"size-full wp-image-71224\" src=\"https:\/\/nomoneylah.com\/wp-content\/uploads\/2021\/06\/HSBC-credit-card-contract-highlighted.jpg\" alt=\"HSBC credit card contract \" width=\"624\" height=\"870\" srcset=\"https:\/\/nomoneylah.com\/wp-content\/uploads\/2021\/06\/HSBC-credit-card-contract-highlighted.jpg 624w, https:\/\/nomoneylah.com\/wp-content\/uploads\/2021\/06\/HSBC-credit-card-contract-highlighted-215x300.jpg 215w\" sizes=\"(max-width: 624px) 100vw, 624px\" \/><\/a><figcaption id=\"caption-attachment-71224\" class=\"wp-caption-text\">Clauses are put in place to protect cardholders from unauthorized transactions.<\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p><span class=\"font-500830\">In addition, <a href=\"https:\/\/www.mastercard.com.my\/en-my\/consumers\/payment-technologies\/safety-and-security\/liability-protection.html\" target=\"_blank\" rel=\"noopener\">MasterCard<\/a>, <a href=\"https:\/\/usa.visa.com\/pay-with-visa\/visa-chip-technology-consumers\/zero-liability-policy.html\" target=\"_blank\" rel=\"noopener\">Visa<\/a>, and <a href=\"https:\/\/www.americanexpress.com\/ca\/en\/security\/fraud-protection\/\" target=\"_blank\" rel=\"noopener\">AMEX<\/a> have their own liability protection in place to protect cardholders from losses due to unauthorized transactions.<\/span><\/p>\n<p><span class=\"font-500830\"><strong>Simply put, if you report your lost\/compromised <em>credit<\/em> card immediately, it is likely you are in a good position to reclaim your monetary losses.<\/strong><\/span><\/p>\n<p><span style=\"color: #ffffff;\">p<\/span><\/p>\n<ol start=\"2\">\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Your_card_is_a_Debit_Card\"><\/span><span class=\"font-500830\"><strong>Your card is a Debit Card<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p><span class=\"font-500830\"><strong>Now, if the lost\/compromised card is a <em>debit<\/em> card, things are less likely to go in your favour. <\/strong><\/span><\/p>\n<p><span class=\"font-500830\"><strong>Reason being, unlike credit cards, there is actually no exact \u2018debit card guideline\u2019 issued by BNM to protect debit card holders against frauds. <\/strong>Well, at least I couldn\u2019t find it online.<\/span><\/p>\n<p><span class=\"font-500830\">Moreover, things are even less in the favour of debit card holders when we look into the fine print of the T&amp;C of a debit card. As you can see below from CIMB\u2019s debit card T&amp;C, liabilities from loss of card or theft are fully the responsibility of the cardholder.<\/span><\/p>\n<figure id=\"attachment_71222\" aria-describedby=\"caption-attachment-71222\" style=\"width: 744px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/nomoneylah.com\/wp-content\/uploads\/2021\/06\/CIMB-Debit-Card-TC.jpg\"><img decoding=\"async\" class=\"size-full wp-image-71222\" src=\"https:\/\/nomoneylah.com\/wp-content\/uploads\/2021\/06\/CIMB-Debit-Card-TC.jpg\" alt=\"CIMB Debit Card T&amp;C\" width=\"744\" height=\"756\" srcset=\"https:\/\/nomoneylah.com\/wp-content\/uploads\/2021\/06\/CIMB-Debit-Card-TC.jpg 744w, https:\/\/nomoneylah.com\/wp-content\/uploads\/2021\/06\/CIMB-Debit-Card-TC-295x300.jpg 295w\" sizes=\"(max-width: 744px) 100vw, 744px\" \/><\/a><figcaption id=\"caption-attachment-71222\" class=\"wp-caption-text\">Debit cards&#8217; T&amp;C are less in favour of users in the event of fraud.<\/figcaption><\/figure>\n<p><span class=\"font-500830\">As such, debit card holders are almost at the mercy of banks in any claim disputes.<\/span><\/p>\n<p><span style=\"color: #ffffff;\">p<\/span><\/p>\n<ol start=\"3\">\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Whose_money_is_lost_Yours_or_the_banks\"><\/span><span class=\"font-500830\"><strong>Whose money is lost? Yours, or the bank\u2019s?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p><span class=\"font-500830\">Next, a million-dollar question:<\/span><\/p>\n<p><span class=\"font-500830\"><strong>Why such a huge difference between credit cards versus debit cards when it comes to money lost from unauthorized transactions? <\/strong><\/span><\/p>\n<p><span class=\"font-500830\"><strong>Reason being, when people fraudulently use your credit card, they\u2019re spending the money of your credit card issuer.<\/strong> Until you pay your credit card due, the loss belongs to the credit card company.<\/span><\/p>\n<p><span class=\"font-500830\"><strong>However, when people fraudulently use your debit card, they\u2019re spending money that you have in your bank account. <\/strong>Meaning, the money leaves your account instantly, regardless of the transaction is fraudulent or not.<\/span><\/p>\n<p><span class=\"font-500830\">As a result, this difference alone produces a huge disparity in how the losses are treated, and how fast your money can be retrieved.<\/span><\/p>\n<p><span class=\"font-500830\">For better understanding, I highly recommend you to watch this video featuring Frank Abagnale, which is a con-man turned US\u2019s federal agent. He is now a consultant for financial and fraud consultancy firm. Below, I list down some less talked about, but equally practical ideas:<\/span><\/p>\n<ol>\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Use_Credit_Card_instead_of_Debit_Card\"><\/span><span class=\"font-500830\"><strong>Use Credit Card instead of Debit Card<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p><span class=\"font-500830\">While credit cards have always been linked with poor spending behavior and debts, it is extremely useful for people that practice financial discipline.<\/span><\/p>\n<p><span class=\"font-500830\"><strong>Using a credit card for online transactions allows you to gain legal fraud protection as outlined by the guideline from BNM. <\/strong><\/span><\/p>\n<p><span class=\"font-500830\">In comparison, debit card does not enjoy such clear protection guideline from the authorities.<\/span><\/p>\n<p><span style=\"color: #ffffff;\">p<\/span><\/p>\n<ol start=\"2\">\n<li>\n<h3><span class=\"ez-toc-section\" id=\"Use_a_Prepaid_Card_eg_BigPay\"><\/span><span class=\"font-500830\"><strong>Use a Prepaid Card (eg. BigPay)<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h3>\n<\/li>\n<\/ol>\n<p><span class=\"font-500830\">If getting a credit card is an issue (eg. Poor spending behaviour), then consider using a prepaid card instead.<\/span><\/p>\n<p><span class=\"font-500830\"><strong>The good thing with prepaid cards like BigPay, is you can keep your card balance very small and only reload the card whenever you want to transact. <\/strong><\/span><\/p>\n<p><span class=\"font-500830\">In addition, BigPay also comes with an app that allows you to freeze your card directly from the app. As such, this allows you to respond immediately after realizing that your card is missing or stolen.<\/span><\/p>\n<p><span class=\"font-500830\">Worse comes to worst, if your card is used for unauthorized transactions, the most you\u2019d lose are the money you reloaded in your prepaid card. \u00a0\u00a0<\/span><\/p>\n<p><span class=\"font-500830\"><strong>p.s.
